Welcome to Red Wing Planner ("the App"), a free, informal tool that helps friends coordinate plans, find each other, and share festival moments. These Terms of Use ("Terms") are a legal agreement between you and Mattias Clymer ("we," "us," "Operator"). By checking "I agree" and using the App, you accept these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. What Red Wing Planner is (and isn't)
Red Wing Planner is a free, casual convenience tool for festival-goers. It is independent and unofficial — it is not affiliated with, sponsored by, or endorsed by the Red Wing Roots Music Festival, Natural Chimneys, the venue, or any festival organizer. It is not a safety, security, navigation, or emergency service. See clause 6.
2. Who can use it
The App is for adults. You must be at least 18 years old to use it, and by signing up you confirm that you are. The App is not directed to or intended for children.
We do not knowingly collect information from anyone under 18. If we learn that someone under 18 — and especially under 13 — has given us information, we will delete it. A parent or guardian who believes their child has used the App should email info@valleyhomesva.com and we will delete the data.
3. Your account
You sign in with your email and a one-time code. Keep access to your email secure — anyone who can read your email codes can access your account. You're responsible for activity under your account. Give us accurate information (including a real name, so friends can find you).
4. Location sharing is your choice
Sharing your location is completely optional and off by default. You decide if and when to drop a pin, share a camp location, or share live location. Location you share is visible only to friends whose requests you have accepted — not to the public, not to strangers, and never sold or given to advertisers.
You can stop sharing, remove a pin, or remove a friend at any time. Location data can be inaccurate, delayed, or unavailable depending on your device, signal, and conditions at the venue. Do not rely on it for safety or in an emergency (clause 6).
5. Acceptable use — the rules
You agree not to use the App to:
- harass, threaten, stalk, follow, surveil, or contact another person against their wishes;
- use someone's shared location to find or approach them without their consent;
- upload content you don't have the rights to, or that infringes anyone's rights;
- upload photos of identifiable people without their permission, or photos of a minor without the permission of their parent or guardian;
- post content that is illegal, harassing, hateful, sexually explicit, or invasive of privacy;
- impersonate anyone, scrape data, or interfere with the App's operation.
We may remove any content and suspend or terminate any account at our sole discretion, at any time, for any reason, including violations of these rules — with no liability to you. Location sharing is for friendly coordination only; using it to track, follow, or harm another person is strictly prohibited and may be reported to law enforcement.
6. Safety — read this
Red Wing Planner is a convenience tool, not a safety or emergency service. It does not monitor your safety, summon help, or guarantee anyone's location or whereabouts.
- In an emergency, call 911. Do not rely on the App to reach, find, or check on anyone.
- Location and other information may be wrong, late, or missing. Never make a safety decision based solely on the App.
- You are responsible for your own safety, your own decisions, and your own conduct at the festival and everywhere else. Attending a festival and meeting people involve inherent risks, and you knowingly and voluntarily assume those risks when you use the App.
7. Your content (photos and posts)
You keep ownership of the photos and content you post. By posting, you give us a non-exclusive, royalty-free license to store, display, and share that content solely to operate the App (for example, showing your gallery photo to your group). This license ends when you delete the content or your account, except for copies already shared with others or kept in routine backups.
You promise that you own or have the rights to everything you post, that it doesn't break the law or infringe anyone's rights, and that any identifiable people in your photos have consented. You are solely responsible for what you post.
8. Copyright / DMCA takedown
If you believe content on the App infringes your copyright, email our designated agent at info@valleyhomesva.com with: (a) your contact info; (b) identification of the work; (c) the location of the material on the App; (d) a statement that you have a good-faith belief the use is unauthorized; (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act; and (f) your signature. We will remove infringing material and may terminate repeat infringers.
9. The App is provided "as is"
The App is provided "AS IS" and "AS AVAILABLE," with all faults and without warranties of any kind, express or implied — including any warranty of accuracy, reliability, availability, uptime, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that location or any other information will be accurate or timely. You use it at your own risk.
10. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or loss of goodwill, arising out of or relating to the App — even if we were advised such damages were possible.
- Our total liability to you for all claims relating to the App will not exceed the greater of (a) the amount you paid us in the 12 months before the claim (which for a free app is $0) or (b) one hundred U.S. dollars ($100).
- Some of these limits may not apply where the law does not allow them (for example, certain personal-injury claims). In that case, this clause applies to the fullest extent the law allows, and the rest of it stays in effect.
11. You agree to cover claims caused by you (indemnification)
You agree to defend, indemnify, and hold harmless the Operator, and its owner, the owner's family members, the Valley Homes Team, and the App's team, contractors, and affiliates (together, the "Protected Parties"), from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your content; (b) your conduct or use or misuse of the App; (c) your violation of these Terms or of any law; or (d) your violation of anyone else's rights. This is your promise to cover problems you cause — it survives even after you stop using the App.
12. Third-party services
The App relies on third-party providers (for example, Supabase for data and sign-in, Cloudflare for hosting and photo storage, and an email provider for sign-in codes). We are not responsible for outages, failures, or acts of those providers.
13. Changes to the App and these Terms
We may change, suspend, or discontinue the App or any feature at any time. We may update these Terms; if we make material changes, we will give notice (such as a prompt in the App) and ask you to agree again before you keep using it. The "Effective date" and "Version" at the top show the current version. Continuing to use the App after non-material updates means you accept them.
14. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access at any time, for any reason, with or without notice. Clauses that by their nature should survive termination (including 7, 9, 10, 11, and 15) survive.
15. Governing law and where disputes happen
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws rules. You agree that any dispute will be brought exclusively in the state or federal courts located in Rockingham County, Virginia, and you consent to the jurisdiction of those courts.
16. The rest
If any part of these Terms is found unenforceable, the rest stays in effect and the unenforceable part is limited to the minimum extent necessary. Our failure to enforce a provision isn't a waiver. These Terms (plus the Privacy Policy) are the entire agreement between you and us about the App. You may not assign your rights under these Terms; we may assign ours.
